2. PROFESSIONAL TECHNICAL SERVICES

• Scope: KilnWright provides technical diagnostics, electrical repair, and maintenance for electric kilns.

• Site Safety: The Client is responsible for ensuring the facility's electrical infrastructure complies with the National Electrical Code (NEC). The Company is not responsible for building-side electrical failures.

• Estimates: Quotes are based on reported symptoms; final pricing is subject to physical inspection.

3. PROPRIETARY VENTILATION PRODUCTS (e.g., Clearflow)

• Manufacturing Warranty: The Company warrants that proprietary ventilation products shall be free from defects in materials and workmanship for a period of 1 Year from the date of purchase.

• Installation: If the product is purchased for self-installation, the Company assumes zero liability for property damage or personal injury resulting from improper installation or failure to follow the provided Technical Manual.

• Exhaust Safety: The Client is responsible for ensuring all exterior wall or roof penetrations comply with local fire codes and that adequate makeup air is available in the workspace.

4. LIMITATION OF LIABILITY & DISCLAIMER

• Aggregate Liability: To the maximum extent permitted by law, the Company’s total liability for any claim shall not exceed the total amount paid by the Client for the specific product or service call in question.

• Consequential Damages: In no event shall the Company be liable for "loss of craft" (damaged ware), loss of business profits, or incidental damages resulting from equipment downtime or firing failure.

• Standard Disclaimer: Nothing in this disclaimer will:

  • Limit or exclude liability for death or personal injury resulting from negligence where required by law;

  • Limit or exclude liability for fraud or fraudulent misrepresentation.

• Website Availability: We do not warrant that the website information is correct, complete, or accurate, nor do we promise to ensure the website remains available.

This Agreement shall be governed by and construed in accordance with the laws of the State of the Commonwealth of Virginia.
